Divorce in the UK: A Step-by-Step Guide to the No-Fault Divorce Process

What Is No-Fault Divorce?

Since April 2022, England and Wales have operated under a no-fault divorce system. This means couples can now end their marriage without having to blame one another or prove fault. The only ground for divorce is that the marriage has irretrievably broken down.

Key Changes Under the New Law

  • No blame required: You simply state the marriage has broken down
  • Joint applications: Couples can apply together
  • No contesting: The divorce itself cannot be contested
  • New terminology: 'Petitioner' becomes 'Applicant', 'Decree Nisi' becomes 'Conditional Order'

The Divorce Process Step by Step

Step 1: Application

Start by completing the divorce application online or by post. You can apply:

  • As a sole applicant
  • Jointly with your spouse

The court fee is currently £593.

Step 2: Acknowledgement

If you apply alone, your spouse receives the application and must acknowledge receipt within 14 days. They cannot contest the divorce, only dispute jurisdiction or validity of the marriage.

Step 3: 20-Week Reflection Period

After the application is issued, there's a mandatory 20-week waiting period. This allows time for:

  • Reflection on the decision
  • Negotiating financial settlements
  • Arranging child custody matters

Step 4: Conditional Order

After 20 weeks, you can apply for a Conditional Order. The court will grant this if satisfied the marriage has broken down.

Step 5: Final Order

Six weeks after the Conditional Order, you can apply for the Final Order. This legally ends your marriage.

Financial Matters and Children

The divorce process is separate from:

  • Financial settlements: Division of assets, property, pensions, and maintenance
  • Child arrangements: Where children live and how often they see each parent

It's crucial to resolve these matters properly, ideally before the Final Order.
